Terms of Use

1. Acceptance

By using fairmarketvaluations.app (the "Site"), you agree to these Terms of Use. If you do not agree, do not use the Site.

2. Instant estimates are informational only

The free instant value range produced by the Site is an automated estimate based on data available at the time of the query. It is not an appraisal, is not signed or certified by a licensed appraiser, and is not intended for lender, insurance, tax, litigation, or estate use. Actual market value can vary materially based on equipment condition, configuration, hours/mileage, service history, geographic factors, and market timing.

3. No warranty on estimate accuracy

The Site and its instant estimates are provided "as is" and "as available" without any warranty of accuracy, merchantability, or fitness for a particular purpose. We do not guarantee that comparable-sales data pulled from third-party sources is complete, current, or correctly matched to your unit.

4. Verified appraisal service (desktop appraisal)

Our verified appraisal is a desktop appraisal: a licensed appraiser reviews the equipment details and photos you provide, along with comparable-sales research, and issues a signed appraisal report (PDF). No on-site inspection is performed at this price point. The service is billed in two stages — see Engagement & Payment Terms below. Delivery timing after receipt of your engagement fee and complete photo set is a target, not a guarantee. Any refund of amounts already paid is governed by the Engagement & Payment Terms.

4a. Engagement & Payment Terms

Two-stage billing. Verified appraisals are billed in two stages, totalling $149 CAD:

  • $49 CAD engagement fee — paid when you submit your request. Authorizes Fair Market Valuations to begin work on your desktop appraisal.
  • $100 CAD report unlock — paid before the completed report is released to you.

Desktop scope. This service does not include an on-site inspection at the $149 CAD price point. The report is prepared from the information, photos, and documents you supply, together with comparable-sales research conducted by the appraiser.

Engagement fee is non-refundable except in the case where Fair Market Valuations declines the assignment (for example, when the equipment is out of scope or when insufficient information can be obtained after reasonable follow-up). In that case, the $49 CAD engagement fee is refunded to the original payment method.

Photo deadline (14 days). You must submit the required photos within 14 days of paying the engagement fee. We'll email reminders. If the required photo set is not received within 14 days, the engagement lapses, the engagement fee is retained, and you will need to submit a new request (and pay a new engagement fee) to resume.

Report unlock window (30 days). Once the appraiser marks your report ready and emails your unlock link, you have 30 days to pay the $100 CAD balance and unlock the report. After 30 days, the unlock link expires; email hello@fairmarketvaluations.app to reissue.

Payment currency. All amounts are in Canadian dollars (CAD).

Your agreement. Paying the $49 CAD engagement fee, and confirming the consent statement at checkout, constitutes your agreement to these Engagement & Payment Terms.

5. Acceptable use

You agree not to (a) submit information about equipment you do not own or have permission to describe; (b) scrape, resell, or redistribute Site content or estimates; (c) attempt to disrupt, reverse-engineer, or gain unauthorized access to the Site; or (d) use the Site to violate any applicable law.

6. Limitation of liability

To the maximum extent permitted by law, Fair Market Valuations and its operators are not liable for any indirect, incidental, consequential, or special damages arising out of your use of the Site or reliance on any estimate or appraisal. Our total aggregate liability for any claim relating to a paid verified appraisal is limited to the amount you paid for that appraisal.

7. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any dispute arising out of these Terms or your use of the Site will be resolved in the courts of Alberta, and you consent to the exclusive jurisdiction and venue of those courts.

8. Changes

We may update these Terms from time to time. Continued use of the Site after an update constitutes acceptance of the revised Terms.
